Producer Suspension Memorandum

To:                   All Licensed South Carolina Insurers and All Unlimited Lines Licensed Producers

From:               South Carolina Insurance Department
                        Producer Licensing Division

Subject:            Notice of Suspension of Producer License and Appointment(s) - Non payment of $35 Fee

Date:                 June 30, 2003

All producers who have not paid the $35 producer administrative fee to the South Carolina Department of Insurance by 5:00 p.m., July 15, 2003, will have their license and appointment(s) suspended.  Payments must be received by 5:00 p.m., July 15, 2003 to avoid penalties and license suspension.  South Carolina Code Ann. Section 38-43-80 states that a producer’s license may be canceled if they do not comply with the requirements of this section.  This action is being taken by the Department after allowing producers several extensions over a four-month period to comply with their statutorily required responsibility.

If a producer fails to pay the $35 administrative fee by 5:00 p.m., July 15, he/she must complete the following requirements in order to regain licensing and appointment(s) privileges:

1.       Pay a $50 penalty plus the $35 administrative fee.   The $85 payment must be in certified funds made payable to the South Carolina Department of Insurance.

2.   Submit a properly completed Personal Information Data Sheet. All blank spaces must be completed. A copy of the Personal Information Data Sheet is available at:  http://www.doi.sc.gov/Eng/Public/Agents/personaldatasheet_blank.pdf

3.       Provide the Department with a self-addressed, stamped envelope for return of the license.

The producer’s license and appointment(s) will remain suspended until items 1, 2, and 3 above have been received.  As a reminder, insurers are prohibited by law from accepting policies, or permitting an unlicensed producer to perform any of the requirements of a licensed producer on any policy of insurance written by them.
